Service agreement details

Website Terms & Conditions

These provisions apply to website design, development, and monthly maintenance services provided by LoTyde Tech Assistance. They form part of the customer service agreement. For public package descriptions and pricing, see the Websites page and Pricing.

1. Domain Registration and Renewal

Where domain registration or renewal is included in a customer’s selected maintenance plan, LoTyde Tech Assistance will cover eligible standard domain registration and renewal costs of less than $30 per year.

Domains costing $30 or more per year, premium domains, and unusually expensive domain extensions are not covered by the included allowance. Additional domain costs must be disclosed to and approved by the customer before the expense is incurred.

Domain registration and renewal are subject to the registrar’s pricing, policies, and availability. Domain ownership and transfer upon cancellation are governed by the Domain Ownership and Transfer policy below.

Public pricing note: Website hosting and an eligible standard domain are included with your monthly maintenance plan. Additional charges may apply to premium domains and services not covered by your plan.

2. Website Adjustment Policy

An adjustment is an alteration to a small section of existing website content or an informational element.

Examples include:

Adjustments must remain within the website’s existing structure and functionality. Creating new pages, major redesigns, adding complex features, or extensive content changes are not included and may require a separate quote.

Each adjustment is subject to the monthly allowance and time limits of the selected plan. Unused adjustments and hours do not roll over. Additional work will be discussed with and approved by the customer before it begins.

Plan-specific adjustment allowances

These allowances cover existing website content and qualifying adjustments, not unlimited development or technical support.

3. Hosting, Forms, and Third-Party Services

LoTyde Tech Assistance provides website hosting through its selected hosting arrangement and may use third-party services to support website functionality, including contact forms and streaming integrations.

Services are subject to the applicable provider’s availability, limits, pricing, and terms.

Eligible standard hosting and domain costs are included in the customer’s selected maintenance plan as described in the service agreement. Premium domains, paid third-party services, or other costs outside the included plan require disclosure and customer approval before additional charges are incurred.

Customers are responsible for maintaining and paying for third-party accounts and subscriptions assigned to them, including Sermon.net subscriptions.

LoTyde Tech Assistance does not guarantee uninterrupted availability of third-party platforms or services.

4. Cancellation and 30-Day Notice

Customers must provide at least 30 days’ written notice to cancel their website management service with LoTyde Tech Assistance.

The customer’s service remains paid through the applicable 30-day notice period. The website may remain online for part of that period while LoTyde completes the required shutdown and handoff steps. The website will be deactivated within the notice period, with the exact timing depending on the work required to complete the shutdown.

If the customer does not provide the required 30 days’ notice, LoTyde Tech Assistance will retain relevant customer information for 30 days to coordinate the domain transfer and applicable handoff arrangements. The remaining payment for the current billing month will not be refunded, subject to applicable law and the agreed billing terms.

When the website is deactivated, LoTyde-provided hosting, maintenance, contact forms, security checks, and other website services will cease.

LoTyde will coordinate the domain transfer and provide the website data and files included in the standard handoff. The handoff does not include access to LoTyde’s Cloudflare account, hosting account, credentials, internal systems, or non-transferable third-party services.

The customer is responsible for arranging replacement hosting and any other services they wish to continue using. Website migration, rebuilding, and additional technical work are not included in the standard handoff and may be quoted separately with the customer’s approval.

The customer must cooperate with reasonable transfer requirements, including providing the necessary account details and accepting the domain transfer.

5. Domain Ownership and Transfer Upon Cancellation

When website management services end, LoTyde Tech Assistance will coordinate the transfer of the customer’s domain name to the customer or their designated registrar account.

For domains registered through Porkbun, LoTyde may initiate a transfer to the customer’s own Porkbun account. The customer must provide the required account information and complete any verification or acceptance steps required by the registrar.

After the transfer, the customer is responsible for future domain renewal costs and any related services they choose to maintain, unless otherwise agreed in writing.

Domain ownership is separate from website hosting and maintenance. Transferring the domain does not automatically keep the website online or transfer hosting, contact forms, email services, or third-party subscriptions.

LoTyde Tech Assistance will deactivate the website hosted through its hosting arrangement within the applicable notice period. The customer must arrange replacement hosting if they wish to publish the website again.

The standard handoff does not include access to LoTyde’s Cloudflare account, hosting account, internal systems, or credentials. Additional migration or technical work may be quoted separately and requires customer approval before work begins.

6. Website Data and Files Included in the Handoff

When website management services end, LoTyde Tech Assistance will provide the customer with a copy of the website files and customer website data included in the standard handoff, to the extent the materials are owned by the customer or can legally be provided.

Depending on the website, the handoff may include:

Where customer data is stored separately from the website files, LoTyde will provide an available export of that data when it is accessible and legally transferable.

LoTyde Tech Assistance retains copies of active customer websites to support the handoff process. These copies are used to provide the customer with their website files before deactivation.

The standard handoff does not include access to LoTyde’s Cloudflare account, hosting account, internal systems, credentials, proprietary tools, or third-party services that are not transferable.

Upon the end of the applicable service period, LoTyde will deactivate the website hosted through its hosting arrangement within the applicable notice period. Hosting, maintenance, contact forms, security checks, and other LoTyde-provided services will cease.

The customer is responsible for arranging replacement hosting and any additional services required to publish the website again. Website migration, rebuilding, and additional technical work are not included in the standard handoff and may be quoted separately with the customer’s approval.

Website files and website data are not always the same. For example, contact form submissions may be stored by a third-party form provider rather than in the website files. The availability of those records depends on the third-party provider and the available export options.

7. Website Security and Maintenance

LoTyde Tech Assistance performs website checks according to the customer’s selected maintenance plan. Depending on the plan and website setup, these checks may include reviewing website availability and functionality, inspecting the live website, examining available website code with AI-assisted analysis, and looking for suspicious changes or potentially malicious code.

AI-assisted reviews are used as an aid to inspection and are not a guarantee that all malware, vulnerabilities, or suspicious activity will be detected. Checks are performed according to the selected plan and are not continuous monitoring unless expressly agreed in writing.

Malware removal, incident response, compromised-account recovery, major repairs, rebuilding, and extensive recovery work are not included unless expressly stated in the customer’s agreement. Additional work will be explained and approved before it begins.

Security checks are intended to identify potential problems and reduce risk. They do not guarantee that every threat will be detected or prevented.

8. Sermon.net Website Integration Terms

Sermon.net website integration is included upon request for Premium Maintenance and Complete Website Care customers, provided the requested integration is supported and falls within the agreed scope.

The benefit covers the initial integration of a supported player, media center, or link into the website. It does not include unlimited modifications or ongoing streaming management.

Subsequent changes must fit within the plan’s adjustment allowance or be quoted separately.

The customer is responsible for maintaining their Sermon.net account and subscription, uploading and managing sermons, scheduling livestreams, managing recordings, and contacting Sermon.net for platform-related support.

LoTyde Tech Assistance does not provide sermon uploading, sermon library management, livestream operation, or Sunday streaming support.

Sunday is LoTyde Tech Assistance’s regular day off. Live-service support and emergency livestream troubleshooting are not included.

Customers on other website packages may request Sermon.net integration for an additional quoted fee.

9. Monthly Payments and Service Suspension

Monthly website maintenance payments may be made by credit or debit card, check, or cash. Card details may be retained on file where authorized by the customer and handled using an appropriate payment-processing method.

Monthly payments are due by the fifth day of each month. If the fifth falls on a Sunday, payment is due on the sixth.

If payment has not been received by the applicable due date, LoTyde Tech Assistance will send the customer a notice of nonpayment.

Payment must be received by the tenth day of the month to avoid possible suspension of services.

If payment has not been received by the tenth, LoTyde Tech Assistance may suspend services according to the customer’s plan and the circumstances. Suspension may include temporarily taking the website offline or suspending maintenance, contact forms, or other LoTyde-provided services.

Services may resume after the outstanding payment is resolved.

Customers remain responsible for applicable charges under their service agreement. Any suspension, late charges, or related actions are subject to the agreed terms and applicable law.
